JOZBEE Terms of Use

1. Acceptance of Terms
These Terms of Use (“Terms”) constitute a legally binding agreement between you and JOZBEE Learning LLC (“JOZBEE,” “we,” “us,” or “our”) governing your access to and use of the JOZBEE website, mobile applications, artificial-intelligence-powered learning features, educational content, games, activities, subscriptions, and related products and services (collectively, the “Services”).
Please read these Terms carefully before using the Services.
By creating an account, purchasing or starting a subscription or free trial, accessing or using the Services, or permitting a child to access or use the Services through an account you control, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you are a parent or legal guardian permitting a child to use JOZBEE, you agree to these Terms on your own behalf and, to the extent permitted by applicable law, on behalf of the child whose use of the Services you authorize.
If you do not agree to these Terms, you must not access or use the Services or permit a child under your supervision to use the Services.
You represent that you have the legal capacity and authority to enter into these Terms. If you create or control an account for a child, you further represent that you are the child’s parent or legal guardian, or otherwise have lawful authority to provide any permissions or consents required for that child’s use of the Services.
JOZBEE may modify these Terms as described below. Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
2. Parent and Guardian Accounts and Children’s Use
JOZBEE is designed for children, but the primary account for a child must be created, controlled, or authorized by a parent or legal guardian.
A parent or legal guardian is responsible for supervising the child’s use of the Services and for determining whether JOZBEE and its content, activities, games, AI-powered features, and other functionality are appropriate for that child.
Parent and Guardian Responsibility
By creating or controlling an account for a child, the parent or legal guardian agrees to:
• Provide accurate information when creating and maintaining the account.
• Maintain the confidentiality and security of account credentials.
• Supervise the child’s use of JOZBEE as reasonably appropriate for the child’s age and circumstances.
• Ensure that the child uses the Services in accordance with these Terms.
• Review and manage applicable permissions, parental controls, subscriptions, and account settings.
• Notify JOZBEE promptly if the parent or guardian believes an account has been accessed or used without authorization.
The parent or legal guardian is responsible for activity occurring through the account to the extent permitted by applicable law.
Children’s Accounts and Profiles
Children may use child profiles or other child-facing portions of JOZBEE only through an account or access arrangement authorized by a parent or legal guardian.
Children must not independently represent that they are a parent or legal guardian, provide parental consent on behalf of themselves or another person, or circumvent parental controls, age-related protections, account restrictions, or security features.
JOZBEE may suspend, restrict, or terminate access when we reasonably believe an account was created without appropriate authorization, required parental consent has not been obtained, account information is materially inaccurate, or continued access could violate applicable law or create a safety, privacy, or security concern.
Parental Consent and Privacy
Where applicable law requires verifiable parental consent before JOZBEE collects, uses, or discloses a child’s personal information, JOZBEE will seek the required consent before engaging in the applicable activity.
Collection and use of personal information through JOZBEE are also governed by the JOZBEE Privacy Policy.
A parent or legal guardian may withdraw consent or request deletion of eligible child information as described in the Privacy Policy and applicable law. Withdrawal of consent or deletion of information may result in some or all features becoming unavailable.
No Circumvention of Age or Safety Protections
Users may not provide false age information, impersonate a parent or legal guardian, bypass parental-consent mechanisms, disable or circumvent safety features, or assist another person in doing so.
JOZBEE reserves the right to take reasonable measures to verify account eligibility, parental authority, or consent when necessary to protect children, comply with law, or protect the Services.
3. AI-Powered Features and Educational Disclaimer
JOZBEE may provide artificial-intelligence-powered features, including tutoring assistance, explanations, homework help, practice questions, recommendations, feedback, interactive learning activities, and other educational tools (“AI Features”).
AI May Make Mistakes
Artificial intelligence is an evolving technology. AI-generated responses may occasionally be inaccurate, incomplete, outdated, inappropriate, misleading, or otherwise incorrect.
JOZBEE does not represent or warrant that information, explanations, answers, recommendations, calculations, translations, or other content generated by AI Features will always be accurate, complete, error-free, or appropriate for every child or situation.
Parents, guardians, and users should use reasonable judgment when relying on AI-generated information and should independently verify important information when appropriate.
Educational Assistance — Not a Replacement for Teachers or Schools
JOZBEE is intended to supplement learning and provide educational assistance. It is not intended to replace a child’s teacher, school, curriculum, educational program, tutor, or other qualified educational professional.
Users should follow the requirements and instructions provided by their school, teacher, educational institution, or applicable curriculum when completing graded assignments, examinations, or other academic work.
No Guaranteed Academic Results
JOZBEE does not guarantee any particular educational or academic result from use of the Services.
Without limiting the foregoing, JOZBEE does not guarantee that use of the Services will result in improved grades, test scores, reading levels, academic placement, school performance, skill mastery, admission to any school or program, or any other particular educational outcome.
A child’s learning and academic performance may depend on many factors outside JOZBEE’s control.
Homework and Assignment Assistance
JOZBEE may help users understand questions, work through problems, practice skills, review educational materials, or receive explanations related to homework and other assignments.
JOZBEE does not guarantee that an AI-generated answer or solution will be accepted as correct by a teacher, school, testing organization, curriculum provider, or educational institution.
Parents and users are responsible for determining whether use of JOZBEE is permitted for a particular assignment, examination, classroom, school, or educational program.
JOZBEE must not be used to engage in academic dishonesty or to violate a school’s, teacher’s, testing organization’s, or educational institution’s rules.
Age and Individual Differences
Educational content and AI-generated assistance may be adapted based on information available to JOZBEE, such as age, grade level, learning progress, preferences, or prior interactions.
However, every child learns differently. JOZBEE does not guarantee that any particular explanation, activity, difficulty level, recommendation, or learning approach will be appropriate or effective for every child.
Parents and legal guardians remain responsible for determining whether content and activities are appropriate for their child.
Not Professional Advice
JOZBEE provides educational information and learning assistance only.
Unless expressly stated otherwise, the Services are not intended to provide medical, psychological, mental-health, legal, financial, diagnostic, therapeutic, or other professional advice or services.
Users should seek assistance from an appropriately qualified professional when professional advice or services are needed.
Human Review and Parental Supervision
Parents and legal guardians should remain reasonably involved in their child’s use of JOZBEE and review AI-generated information when appropriate, particularly when information could materially affect a child’s education, safety, health, or well-being.
JOZBEE may implement filters, safeguards, moderation systems, or other measures intended to improve the safety and quality of AI Features. However, no automated system can identify, prevent, or correct every inaccurate, inappropriate, or unintended response.
4. User Content, Homework, Images, Documents, Drawings, and Voice Input
JOZBEE may allow users to submit, upload, photograph, record, create, or otherwise provide homework, worksheets, questions, written material, drawings, images, documents, voice or audio input, prompts, answers, and other materials through the Services (“User Content”).
Ownership of User Content
As between the user and JOZBEE, users retain any ownership rights they may have in their original User Content.
Submitting User Content to JOZBEE does not transfer ownership of that User Content to JOZBEE.
Permission to Process User Content
By submitting User Content, the parent, legal guardian, or other authorized user grants JOZBEE a limited right to host, store, reproduce, process, analyze, transmit, display, modify as technically necessary, and otherwise use the User Content solely as reasonably necessary to provide, operate, secure, support, personalize, troubleshoot, and improve the Services, subject to the JOZBEE Privacy Policy and applicable law.
This permission includes processing User Content through authorized service providers when reasonably necessary to provide features such as AI-powered tutoring, image analysis, homework assistance, speech or voice processing, data storage, security, and other functionality.
For children's personal information, JOZBEE will process such information only as permitted by applicable law and any required parental authorization or consent.
Permission to Upload Content
Users may submit only User Content that they have the legal right or appropriate permission to use and submit through JOZBEE.
Users must not knowingly upload or submit content that infringes or violates another person’s copyright, trademark, privacy, publicity, intellectual-property, contractual, or other legal rights.
For example, users should not upload copyrighted textbooks, answer keys, paid educational materials, photographs, documents, or other protected materials unless they have permission or another lawful basis to do so.
Personal and Sensitive Information
Parents, guardians, and children should avoid including unnecessary personal, confidential, identifying, or sensitive information in User Content.
Users should not submit information such as Social Security numbers, government identification numbers, passwords, financial account information, payment-card information, precise location information, medical records, or other sensitive information unless JOZBEE expressly requests the information for a specific authorized purpose.
Parents and guardians should review photographs, screenshots, documents, and other uploads when appropriate to ensure that unnecessary personal information is not visible.
Images and Photographs of Other People
Users should not submit photographs, recordings, or other content depicting another person when they do not have appropriate permission to submit that material.
Parents and guardians are responsible for supervising content submitted through child profiles under their control.
Voice and Audio Features
If a user activates a voice-enabled feature, JOZBEE may process audio or information derived from that audio as reasonably necessary to understand the user’s request and provide the requested functionality.
Use of a device microphone remains subject to applicable device permissions and the JOZBEE Privacy Policy.
Removal or Restriction of User Content
JOZBEE may remove, restrict, reject, quarantine, or disable access to User Content when we reasonably believe the content violates these Terms, infringes another person’s rights, creates a privacy or security concern, could harm a user or the Services, or must be restricted to comply with applicable law.
No Obligation to Preserve User Content
Except as required by applicable law or expressly stated by JOZBEE, users should not rely on JOZBEE as the sole storage location for important homework, documents, drawings, photographs, recordings, or other materials.
JOZBEE does not guarantee that User Content will remain available indefinitely, and users should retain copies of important materials when appropriate.
5. Acceptable Use and Prohibited Conduct
Users may use JOZBEE only for lawful, appropriate educational purposes and in accordance with these Terms.
Parents and legal guardians are responsible for supervising use of the Services through accounts and child profiles under their control.
Prohibited Uses
Users may not use, attempt to use, or permit another person to use the Services to:
• Violate any applicable law, regulation, court order, or legal obligation.
• Engage in academic dishonesty, cheating, plagiarism, or other conduct prohibited by a school, teacher, testing organization, educational institution, or curriculum provider.
• Upload, transmit, request, create, or distribute content that is unlawful, threatening, abusive, harassing, defamatory, obscene, sexually explicit, exploitative, discriminatory, hateful, violent, or otherwise inappropriate for the Services.
• Exploit, endanger, groom, sexualize, threaten, harass, or otherwise harm a child or any other person.
• Upload or distribute child sexual abuse material or other illegal or exploitative content. JOZBEE may report suspected illegal activity to appropriate authorities when required or permitted by law.
• Encourage or provide instructions for suicide, self-harm, dangerous activities, illegal drug use, weapons-related wrongdoing, criminal activity, or other conduct presenting a substantial risk of harm.
• Submit another person's personal, confidential, private, or sensitive information without appropriate authorization.
• Infringe or misappropriate copyrights, trademarks, patents, trade secrets, privacy rights, publicity rights, or other intellectual-property or legal rights.
• Impersonate another person, falsely represent an affiliation, provide materially false account information, or misrepresent parental or legal-guardian authority.
• Circumvent or attempt to circumvent parental controls, age restrictions, content protections, security measures, usage limitations, moderation systems, or other safeguards.
• Attempt to obtain unauthorized access to JOZBEE, another user's account, computer systems, networks, databases, source code, models, prompts, security mechanisms, or nonpublic portions of the Services.
• Introduce malware, viruses, malicious code, automated attacks, excessive requests, or other technology intended to damage, disrupt, overload, interfere with, or compromise the Services.
• Scrape, crawl, harvest, extract, copy, systematically download, or collect data or content from the Services through automated means except where expressly authorized by JOZBEE or permitted by applicable law.
• Reverse engineer, decompile, disassemble, decode, reproduce, modify, or attempt to derive source code, algorithms, models, prompts, system instructions, or underlying components of the Services except to the limited extent such restriction is prohibited by applicable law.
• Use JOZBEE, its content, outputs, data, or Services to develop, train, improve, benchmark, or operate a competing artificial-intelligence model, educational service, application, or commercial product except with JOZBEE's prior written authorization or where such restriction is prohibited by applicable law.
• Resell, sublicense, rent, lease, commercially exploit, or provide unauthorized access to the Services.
• Use the Services in a manner that interferes with another person's use of JOZBEE or that could damage JOZBEE, its users, service providers, systems, reputation, or operations.
AI Safety and Misuse
Users must not intentionally manipulate, jailbreak, circumvent, or defeat safeguards associated with JOZBEE's AI-powered features.
Users must not intentionally prompt JOZBEE to generate content that violates these Terms or use AI-generated content to facilitate unlawful or harmful activity.
Because automated safeguards are not perfect, parents and legal guardians remain responsible for reasonably supervising their child's use of AI-powered features as described in these Terms.
Enforcement
JOZBEE may investigate suspected violations of these Terms and may remove or restrict content, limit functionality, suspend or terminate accounts or access, preserve relevant information, or take other reasonable measures when JOZBEE believes such action is necessary to protect children, users, JOZBEE, its service providers, or the Services; enforce these Terms; prevent fraud or abuse; or comply with applicable law.
Where appropriate and legally permitted, JOZBEE may cooperate with law enforcement, courts, regulators, child-safety organizations, or other appropriate authorities regarding suspected unlawful conduct or threats to safety.
JOZBEE is not obligated to monitor every communication, upload, AI interaction, or activity occurring through the Services and cannot guarantee that all prohibited conduct or inappropriate content will be detected or prevented.
6. Subscriptions, Free Trials, Billing, Renewals, Cancellations, and Refunds
JOZBEE may offer free features, paid subscriptions, free trials, promotional offers, or other paid products or services. Available plans, prices, billing periods, features, and promotional terms may vary and will be displayed before purchase.
Subscriptions
Certain JOZBEE features may require a paid subscription.
By purchasing a subscription, the account holder authorizes the applicable app store, payment processor, or other authorized billing provider to charge the displayed subscription price, together with any applicable taxes or fees, in accordance with the terms presented at the time of purchase.
Automatic Renewal
Unless otherwise stated at the time of purchase, paid subscriptions automatically renew at the end of each applicable subscription period unless canceled before renewal in accordance with the requirements of the applicable billing provider.
The applicable app store or payment provider may charge the account holder for the renewal according to its billing policies.
Users are responsible for managing and canceling subscriptions through the platform or payment provider through which the subscription was purchased.
Free Trials and Promotional Offers
JOZBEE may offer free trials or promotional subscription periods to eligible users.
The duration and specific terms of a free trial or promotional offer will be disclosed when the offer is presented.
Unless otherwise disclosed or prohibited by applicable law, a free trial associated with an automatically renewing subscription may convert to a paid subscription at the end of the trial period unless canceled before the trial expires.
Eligibility for free trials and promotional offers may be limited, and JOZBEE may determine eligibility to the extent permitted by applicable law and platform requirements.
Cancellation
Subscriptions may be canceled using the subscription-management method provided by the app store, payment processor, JOZBEE account settings, or other billing provider through which the subscription was purchased.
Deleting the JOZBEE application, discontinuing use of the Services, or deleting a child profile does not necessarily cancel an active paid subscription.
Unless otherwise required by applicable law or the applicable billing provider's rules, cancellation generally prevents future renewal charges but does not terminate access to paid features before the end of the subscription period already paid for.
Refunds
Payments and refunds for purchases made through an app store or third-party payment provider are subject to that provider's applicable billing and refund policies.
Except where a refund is required by applicable law, required by the applicable app store or payment provider, or expressly offered by JOZBEE, payments are non-refundable and JOZBEE does not provide refunds or credits for partially used subscription periods, unused features, changes in usage, or failure to use the Services.
Nothing in these Terms limits any refund, cancellation, or consumer right that cannot lawfully be waived.
Price Changes
JOZBEE may change subscription prices, available plans, included features, or billing structures from time to time.
Any price change affecting an existing automatically renewing subscription will be handled in accordance with applicable law and the requirements of the applicable app store or payment provider, including any notice or consent required before the changed price takes effect.
Taxes and Charges
Displayed prices may not include applicable taxes or similar governmental charges unless stated otherwise.
Users are responsible for applicable charges associated with their purchase to the extent permitted by law.
Payment Problems
JOZBEE or the applicable billing provider may suspend, restrict, or terminate access to paid features if a payment is declined, reversed, disputed, canceled, fraudulent, unauthorized, or otherwise not successfully completed.
JOZBEE may restore access after the applicable payment issue has been resolved.
No Guarantee of Continued Pricing or Features
Purchasing a subscription does not guarantee that every feature, activity, game, AI capability, content item, or other component of JOZBEE will remain available indefinitely or remain unchanged.
JOZBEE may modify, replace, add, discontinue, or improve features and content as described in these Terms, subject to applicable law and any rights that cannot legally be waived.
7. Intellectual Property Rights
JOZBEE and the Services, including their software, technology, design, layout, appearance, functionality, educational materials, games, activities, graphics, illustrations, characters, mascots, logos, trademarks, trade names, text, audio, video, animations, interfaces, databases, compilations, and other content created or provided by JOZBEE (“JOZBEE Content”), are owned by or licensed to JOZBEE Learning LLC and are protected by applicable intellectual-property laws.
JOZBEE Ownership
Except for User Content addressed elsewhere in these Terms, JOZBEE retains all right, title, and interest in and to the Services and JOZBEE Content, including all associated intellectual-property rights.
Use of the Services does not transfer ownership of JOZBEE, the JOZBEE Content, software, technology, trademarks, characters, designs, or other intellectual property to any user.
Limited License to Users
Subject to compliance with these Terms and payment of any applicable subscription fees, JOZBEE grants authorized users a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services and JOZBEE Content solely for personal, noncommercial educational purposes.
No other rights are granted except as expressly stated in these Terms.
Restrictions
Except where expressly authorized by JOZBEE or permitted by applicable law, users may not copy, reproduce, republish, upload, post, publicly display, publicly perform, distribute, sell, license, sublicense, modify, create derivative works from, commercially exploit, or otherwise use JOZBEE Content outside the ordinary permitted use of the Services.
Users may not remove, obscure, alter, or interfere with copyright notices, trademarks, proprietary notices, watermarks, attribution, or other ownership markings contained in or associated with the Services.
JOZBEE Name, Logo, Characters, and Branding
JOZBEE, the JOZBEE name, logos, bee characters and mascots, designs, slogans, graphics, and related branding are proprietary to JOZBEE Learning LLC or its licensors.
Nothing in these Terms grants users permission to use JOZBEE's trademarks, logos, characters, branding, or other identifying materials for commercial, promotional, endorsement, merchandising, domain-name, social-media, application, or business purposes without prior written authorization from JOZBEE.
Users may not use JOZBEE branding in a manner likely to cause confusion regarding affiliation, sponsorship, endorsement, or authorization.
Educational Content
JOZBEE may provide educational questions, explanations, activities, games, worksheets, examples, exercises, learning materials, and AI-assisted educational content.
Such materials are provided for authorized use within the Services and may not be systematically copied, extracted, redistributed, republished, sold, or used to create a competing product or service except where expressly permitted by JOZBEE or applicable law.
AI-Generated and AI-Assisted Outputs
Certain outputs provided through JOZBEE may be generated or assisted by artificial intelligence.
To the extent permitted by applicable law, users may use outputs generated specifically in response to their authorized use of JOZBEE for personal, noncommercial educational purposes.
Because laws concerning artificial-intelligence-generated material continue to develop, JOZBEE does not represent or warrant that any particular AI-generated output is eligible for copyright or other intellectual-property protection, is unique, or will not be similar to content generated for another user.
Users are responsible for determining whether their intended use of an output is lawful and appropriate.
Feedback and Suggestions
If a user voluntarily provides JOZBEE with ideas, suggestions, recommendations, feature requests, improvements, comments, or other feedback regarding the Services (“Feedback”), the user grants JOZBEE a worldwide, perpetual, irrevocable, royalty-free right to use, reproduce, modify, develop, incorporate, commercialize, and otherwise use that Feedback without compensation or obligation to the user, to the extent permitted by applicable law.
Feedback does not include a child's personal information or User Content submitted for the purpose of receiving educational assistance.
Reservation of Rights
All rights not expressly granted to users under these Terms are reserved by JOZBEE Learning LLC and its licensors.
8. Copyright Complaints and Intellectual Property Infringement
JOZBEE respects the intellectual-property rights of others and expects users of the Services to do the same.
Reporting Copyright or Intellectual Property Concerns
If you believe that content available through JOZBEE infringes your copyright or other intellectual-property rights, you may contact JOZBEE using the contact information below.
A notice should include sufficient information for JOZBEE to reasonably identify and evaluate the claimed infringement, including, as applicable:
• Identification of the copyrighted work or other intellectual property claimed to have been infringed.
• Identification or description of the material claimed to be infringing and sufficient information to allow JOZBEE to locate the material.
• The name and contact information of the person submitting the notice.
• A statement that the person submitting the notice has a good-faith belief that the disputed use is not authorized by the rights owner, its agent, or applicable law.
• A statement that the information provided in the notice is accurate and, where applicable, that the person submitting the notice is authorized to act on behalf of the owner of the rights involved.
• A physical or electronic signature where required by applicable law.
JOZBEE may request additional information reasonably necessary to evaluate or respond to a complaint.
Response to Infringement Claims
JOZBEE may remove, disable access to, restrict, or investigate material that JOZBEE reasonably believes may infringe another person's intellectual-property rights or violate these Terms.
Where appropriate and permitted by law, JOZBEE may notify the user who submitted the affected material and may provide an opportunity to respond.
Repeat or Serious Infringement
JOZBEE may restrict, suspend, or terminate accounts of users who repeatedly or seriously infringe the intellectual-property rights of others, subject to applicable law and the circumstances of the matter.
False or Misleading Claims
Users must not knowingly submit false, fraudulent, or materially misleading infringement notices or claims.
A person who knowingly misrepresents that material is infringing may be responsible for damages or other consequences under applicable law.

9. Service Availability, Changes, Updates, and Discontinuation
JOZBEE is continually developing and improving the Services. Features, content, educational materials, games, activities, artificial-intelligence capabilities, designs, functionality, and availability may change over time.
Service Availability
JOZBEE does not guarantee that the Services or any particular feature will be available at all times, in every location, on every device, or without interruption.
Access may occasionally be interrupted or limited because of maintenance, updates, technical problems, internet or network conditions, third-party service disruptions, security concerns, legal requirements, or circumstances outside JOZBEE’s reasonable control.
JOZBEE may establish reasonable technical requirements, supported devices, operating-system requirements, internet requirements, storage requirements, or other conditions necessary to use certain features.
Updates and Changes
JOZBEE may update, modify, improve, replace, add, remove, or discontinue features, educational content, games, activities, AI-powered functionality, interfaces, or other portions of the Services.
Updates may be made to improve functionality, security, safety, educational quality, compatibility, legal compliance, or the overall user experience.
Some updates may be required in order to continue using all or part of the Services.
Third-Party Services and Technology
Certain JOZBEE features may depend on third-party technology or services, including hosting, cloud storage, artificial-intelligence processing, speech or voice processing, authentication, analytics, payment processing, app stores, device services, and other technology providers.
JOZBEE is not responsible for interruptions, changes, limitations, or discontinuation caused by third-party services or technology outside JOZBEE’s reasonable control.
Internet and Device Requirements
Certain features may require an internet connection, while other features may be made available for offline use.
Availability of offline functionality may depend on the device, subscription plan, downloaded content, storage capacity, software version, and particular JOZBEE feature being used.
Users are responsible for obtaining and maintaining compatible devices, internet access, mobile data, and other equipment or services necessary to access JOZBEE.
JOZBEE is not responsible for charges imposed by internet, wireless, mobile-data, or other service providers.
Maintenance and Security
JOZBEE may temporarily suspend or restrict access to some or all of the Services when reasonably necessary for maintenance, upgrades, security, fraud prevention, protection of users, investigation of misuse, or compliance with applicable law.
Where reasonably practicable, JOZBEE will seek to minimize unnecessary disruption.
Discontinuation of Features or Services
JOZBEE may discontinue a feature, product, subscription plan, or portion of the Services when reasonably necessary for business, technical, security, legal, educational, or operational reasons.
Any discontinuation affecting a paid subscription will be handled subject to applicable law and applicable app-store or payment-provider requirements.
No Guarantee of Compatibility
JOZBEE does not guarantee that the Services will remain compatible indefinitely with every device, operating system, browser, hardware configuration, or third-party service.
Users may need to install updates or use supported software or devices to continue accessing certain functionality.
10. Third-Party Services, Platforms, and Links
JOZBEE may use, integrate with, or depend upon third-party products, platforms, services, software, websites, application stores, payment processors, artificial-intelligence providers, hosting providers, analytics providers, authentication services, speech or voice-processing services, and other technology providers (“Third-Party Services”).
Third-Party Service Providers
JOZBEE may engage third-party service providers to perform functions on JOZBEE’s behalf or to support the operation, security, functionality, and delivery of the Services.
Use of personal information by service providers acting on JOZBEE’s behalf is addressed in the JOZBEE Privacy Policy.
JOZBEE will seek to use service providers subject to appropriate contractual, privacy, security, and legal requirements where required by applicable law.
App Stores and Device Platforms
The JOZBEE mobile application may be downloaded or accessed through third-party platforms or application stores, including platforms operated by Apple, Google, or other providers.
Use of those platforms may be subject to separate terms, privacy policies, payment rules, subscription requirements, refund policies, and other conditions established by the applicable platform provider.
JOZBEE does not control the operation or policies of third-party app stores or device platforms.
Third-Party Links
The Services may contain links to websites, applications, educational resources, or other services operated by third parties.
A link or reference to a third-party service does not necessarily mean that JOZBEE endorses, controls, sponsors, or is responsible for that third party or its content, products, services, privacy practices, security practices, or availability.
Parents and legal guardians should review third-party websites and services before allowing a child to access or use them.
Third-Party Terms and Privacy Policies
Third-Party Services may be governed by their own terms of use, privacy policies, licenses, and other agreements.
Users are responsible for complying with applicable third-party terms when using those services.
Availability and Changes
JOZBEE is not responsible for the availability, accuracy, functionality, security, modification, suspension, or discontinuation of independent Third-Party Services outside JOZBEE’s reasonable control.
The loss, modification, or unavailability of a Third-Party Service may affect certain JOZBEE features.
No Responsibility for Independent Third Parties
To the extent permitted by applicable law, JOZBEE is not responsible for losses, damages, disputes, purchases, communications, content, or other interactions arising solely between a user and an independent third party that is not acting on JOZBEE’s behalf.
Nothing in this section limits any responsibility JOZBEE has for its own conduct or any responsibility that cannot lawfully be excluded.
11. Disclaimers of Warranties
To the fullest extent permitted by applicable law, the Services are provided on an “AS IS” and “AS AVAILABLE” basis.
JOZBEE Learning LLC makes no representations or warranties that the Services will always be available, uninterrupted, secure, error-free, accurate, complete, reliable, or suitable for every user, child, device, educational purpose, or circumstance.
Educational and AI Content
JOZBEE provides educational tools and learning assistance, including features that may use artificial intelligence.
Artificial-intelligence-generated or assisted content may contain errors, inaccuracies, omissions, outdated information, inappropriate responses, or other unintended results.
JOZBEE does not warrant or guarantee the accuracy, completeness, reliability, suitability, or educational effectiveness of AI-generated responses, explanations, recommendations, calculations, translations, activities, or other content.
Parents, legal guardians, and users should exercise reasonable judgment and independently verify important information when appropriate.
No Guarantee of Educational Results
JOZBEE does not warrant or guarantee that use of the Services will result in any particular educational outcome, including improved grades, test scores, reading levels, academic performance, skill mastery, school placement, admission, or other result.
Educational outcomes depend on numerous factors outside JOZBEE’s control.
No Professional Advice
JOZBEE provides educational information and learning assistance and is not a substitute for professional services.
Unless expressly stated otherwise, JOZBEE does not provide medical, psychological, mental-health, legal, financial, diagnostic, therapeutic, or other professional advice.
Users should consult an appropriately qualified professional when professional advice or services are required.
Technology and Availability
JOZBEE does not warrant that the Services will be compatible with every device, operating system, browser, network, or third-party service or that defects or errors will always be corrected.
JOZBEE does not warrant that files, downloads, communications, AI outputs, or other content will be free from viruses, malicious code, errors, or other harmful components, although JOZBEE may use reasonable safeguards intended to protect the Services.
Third-Party Services
JOZBEE makes no warranties regarding independent third-party websites, platforms, products, services, content, or technology that JOZBEE does not control.
Legal Limitations
Some jurisdictions do not allow the exclusion of certain warranties or provide consumers with rights that cannot be waived.
Accordingly, the disclaimers in these Terms apply only to the maximum extent permitted by applicable law and do not limit any rights that cannot lawfully be excluded or waived.
12. Limitation of Liability
To the fullest extent permitted by applicable law, JOZBEE Learning LLC and its owners, members, officers, employees, contractors, agents, licensors, service providers, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to the Services or these Terms.
This includes, without limitation, damages or losses resulting from loss of data, loss of content, loss of profits or revenue, interruption of service, loss of use, device or software problems, unauthorized access, reliance on educational or AI-generated information, or other intangible losses, even if JOZBEE has been advised of the possibility of such damages.
Educational and AI-Related Liability
To the fullest extent permitted by applicable law, JOZBEE is not liable for losses or damages arising from reliance on AI-generated or AI-assisted answers, explanations, recommendations, translations, calculations, educational materials, activities, or other outputs.
Parents, legal guardians, and users remain responsible for evaluating whether information provided through JOZBEE is appropriate for a particular child, assignment, educational purpose, or circumstance.
User Content
JOZBEE is not responsible for the loss, deletion, corruption, alteration, disclosure, or inability to access User Content except to the extent liability cannot lawfully be excluded.
Users should retain copies of important homework, photographs, documents, drawings, recordings, or other materials submitted through the Services.
Third-Party Services
To the fullest extent permitted by applicable law, JOZBEE is not liable for acts, omissions, interruptions, security incidents, content, products, services, or other conduct of independent third parties that JOZBEE does not control.
Maximum Liability
To the fullest extent permitted by applicable law, the total aggregate liability of JOZBEE Learning LLC and the parties identified above for all claims arising out of or relating to the Services or these Terms will not exceed the greater of:
• The amount actually paid to JOZBEE by the applicable account holder for the Services during the twelve (12) months immediately preceding the event giving rise to the claim; or
• One hundred U.S. dollars (US $100).
The limitations in this section apply regardless of the legal theory on which a claim is based, including contract, tort, negligence, strict liability, statute, or otherwise, to the extent permitted by applicable law.
Exceptions Required by Law
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, JOZBEE’s liability will be limited to the maximum extent permitted by law.
13. Indemnification
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless JOZBEE Learning LLC and its owners, members, officers, employees, contractors, agents, licensors, service providers, and affiliates from and against claims, demands, actions, proceedings, liabilities, damages, judgments, settlements, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:
• Your violation of these Terms.
• Your misuse of the Services.
• User Content submitted, uploaded, transmitted, recorded, created, or otherwise provided through an account under your control.
• Your violation or alleged violation of another person’s intellectual-property, privacy, publicity, contractual, or other legal rights.
• Your violation of applicable law or regulation.
• Fraudulent, unauthorized, abusive, or unlawful activity occurring through an account under your control, to the extent attributable to your acts or omissions.
Parent and Guardian Accounts
If you are a parent or legal guardian who creates, controls, or authorizes an account or child profile, this Section applies to your own acts or omissions and, to the extent permitted by applicable law, your authorization or knowing misuse of the Services through accounts or profiles under your control.
Nothing in this Section requires a parent or legal guardian to indemnify JOZBEE for conduct of a child that the parent or guardian did not authorize, direct, knowingly permit, or reasonably have the ability to control, except to the extent otherwise permitted by applicable law.
JOZBEE’s Defense of Claims
JOZBEE reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification under this Section.
In such circumstances, you agree to provide reasonable cooperation in the defense of the claim.
You may not settle a claim in a manner that imposes liability, obligations, admissions, or restrictions on JOZBEE without JOZBEE’s prior written consent.
Limitations Required by Law
These indemnification obligations apply only to the extent permitted by applicable law and do not require a user to indemnify JOZBEE for JOZBEE’s own fraud, willful misconduct, gross negligence, or other liability that cannot lawfully be shifted to the user.
14. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or relating to the Services, JOZBEE, or these Terms will be governed by the laws of the State of Minnesota, without regard to its conflict-of-law principles, except to the extent federal law or other applicable law requires otherwise.
Informal Resolution of Disputes
Before filing a lawsuit or other formal legal proceeding against JOZBEE, you agree to make a good-faith effort to resolve the dispute informally.
You may begin the informal-resolution process by sending JOZBEE a written notice describing the dispute, the relevant account information, the relief requested, and sufficient information for JOZBEE to evaluate the matter.
JOZBEE may likewise attempt to resolve disputes informally before initiating formal proceedings.
The parties will have at least thirty (30) days after receipt of a dispute notice to attempt to resolve the matter informally before either party initiates a formal proceeding, unless immediate action is reasonably necessary or applicable law provides otherwise.
Venue and Jurisdiction
Except where applicable law permits or requires otherwise, any lawsuit or judicial proceeding arising out of or relating to these Terms or the Services must be brought in a state or federal court having jurisdiction in Minnesota.
You and JOZBEE consent to the personal jurisdiction of such courts for purposes of resolving such disputes.
Small Claims Court
Nothing in these Terms prevents either party from bringing an eligible individual claim in small claims court where jurisdiction and applicable procedural requirements are satisfied.
Injunctive and Equitable Relief
Nothing in this Section prevents JOZBEE or a user from seeking temporary, preliminary, or other appropriate injunctive or equitable relief when reasonably necessary to prevent actual or threatened misuse of intellectual property, unauthorized access, security violations, harm to children or users, or other conduct for which monetary damages may be inadequate.
Consumer Rights
Nothing in these Terms limits any consumer-protection right, statutory remedy, venue right, or other legal right that cannot lawfully be waived or restricted.
No Mandatory Arbitration Unless Separately Agreed
These Terms do not require users to submit disputes to binding arbitration unless JOZBEE and the applicable user separately agree to arbitration in a legally enforceable agreement.
15. Suspension and Termination
JOZBEE may suspend, restrict, disable, or terminate access to some or all of the Services when reasonably necessary to protect users, children, JOZBEE, its service providers, or the integrity and security of the Services, or to comply with applicable law.
Reasons for Suspension or Termination
JOZBEE may take such action when it reasonably believes that:
• A user has violated these Terms or applicable law.
• An account has been used fraudulently, unlawfully, abusively, or without authorization.
• A user has attempted to bypass parental controls, age restrictions, security measures, content safeguards, usage limitations, or other protections.
• Continued access could create a safety, privacy, security, legal, technical, or operational risk.
• Payment for a paid subscription has been declined, reversed, disputed, canceled, or otherwise not successfully completed.
• Suspension or termination is required by a court order, government authority, app-store requirement, payment provider, or applicable law.
• JOZBEE discontinues the applicable Service, feature, or account type.
Termination by the User
An account holder may stop using JOZBEE at any time and may request deletion of an eligible account in accordance with the options made available through JOZBEE.
Deleting an account does not necessarily cancel an active subscription purchased through an app store or other third-party billing provider. Subscriptions must be canceled using the applicable subscription-management method.
Effect of Termination
Upon termination or deletion of an account, the right to access and use the applicable Services ends, except as otherwise required by applicable law.
User Content, account information, and other data may be deleted, retained, or otherwise handled in accordance with the JOZBEE Privacy Policy, applicable law, legitimate business needs, and legal obligations.
Users should retain copies of important materials they wish to preserve before deleting an account when reasonably possible.
Survival
Provisions of these Terms that by their nature should survive termination will remain in effect after termination, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution, and other provisions necessary to interpret or enforce these Terms.
16. Changes to These Terms
JOZBEE may update or modify these Terms from time to time to reflect changes to the Services, features, technology, business practices, legal requirements, safety practices, or other operational needs.
Notice of Material Changes
When required by applicable law, JOZBEE will provide reasonable notice of material changes to these Terms. Notice may be provided through the Services, by email, through an account notification, on the JOZBEE website, or by another reasonable method.
The updated Terms will identify their effective date.
Acceptance of Updated Terms
Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
If applicable law requires additional consent to a material change, JOZBEE will seek that consent before the change becomes binding on the affected user.
If an account holder does not agree to updated Terms, the account holder should discontinue use of the Services and may cancel any applicable subscription and request account deletion in accordance with these Terms.
Changes Affecting Children
Where reasonably appropriate or required by law, material changes affecting the collection, use, disclosure, or handling of children's personal information will be addressed in accordance with the JOZBEE Privacy Policy and applicable children's privacy laws.
Prior Versions
Unless otherwise required by applicable law, updated Terms replace prior versions as of the stated effective date.
17. Electronic Communications and Notices
By creating a JOZBEE account, using the Services, or providing an email address or other electronic contact information, you consent to receive communications from JOZBEE electronically as permitted by applicable law.
Electronic Communications
JOZBEE may communicate with account holders through email, in-app messages, account notifications, website notices, push notifications, or other electronic methods associated with the Services.
Communications may include account information, security alerts, parental-consent or verification notices, subscription and billing information, changes to the Services or these Terms, Privacy Policy updates, customer-support communications, and other administrative or legally required notices.
Legal Notices
To the extent permitted by applicable law, electronic communications from JOZBEE satisfy any legal requirement that such communications be provided in writing.
Account holders are responsible for maintaining accurate and current contact information associated with their JOZBEE account.
Marketing Communications
JOZBEE may send promotional or marketing communications only as permitted by applicable law.
Recipients may unsubscribe from promotional emails using the unsubscribe method provided in those communications. Opting out of promotional communications will not prevent JOZBEE from sending necessary transactional, security, account, parental-consent, billing, or legal communications
Push Notifications
If enabled on a device, JOZBEE may send push notifications relating to the Services. Device settings may be used to manage or disable push notifications.

18. General Provisions
Entire Agreement
These Terms, together with the JOZBEE Privacy Policy and any additional terms or policies expressly incorporated by reference, constitute the entire agreement between the applicable account holder and JOZBEE Learning LLC concerning use of the Services and supersede prior or contemporaneous agreements, communications, or understandings concerning the same subject matter.
Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law or modified to the minimum extent necessary to make it enforceable. The remaining provisions will remain in full force and effect.
No Waiver
JOZBEE's failure or delay in exercising or enforcing any right or provision of these Terms does not constitute a waiver of that right or provision.
Any waiver must be expressly made by JOZBEE and will apply only to the specific circumstances for which it was give.
Assignment
Users may not assign or transfer their rights or obligations under these Terms without JOZBEE's prior written consent.
JOZBEE may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, reorganization, sale of assets, change of control, financing, or other business transaction, or as otherwise permitted by applicable law.
No Third-Party Beneficiaries
Except as expressly provided in these Terms or required by applicable law, these Terms do not create rights or remedies for any person or entity other than the parties to these Terms.
Headings
Section titles and headings are provided for convenience only and do not affect the interpretation of these Terms.
Interpretation
Words such as "including" and "include" are intended to be illustrative and do not limit the general meaning of the preceding language.
References to applicable law include applicable statutes, regulations, rules, orders, and legally binding governmental requirements.
Force Majeure
To the extent permitted by applicable law, JOZBEE will not be responsible for delay, interruption, or failure to perform caused by circumstances beyond its reasonable control, including natural disasters, severe weather, fire, flood, war, terrorism, civil unrest, labor disruptions, internet or telecommunications failures, power outages, cyberattacks, governmental actions, epidemics, pandemics, or failures of third-party infrastructure or service providers.
